FILING OF PCT APPLICATION IN IP PHILIPPINES AS RECEIVING OFFICE


  1. Can I file an International Application in the Philippines?

    Yes. Starting August 17, 2001, a Philippine national or resident can file an international application in the Philippines with the Intellectual Property Office of the Philippines (IP Philippines) as a receiving office.
  1. What are the requisites to obtain an international filing date where the PCT application is filed with IP Philippines?

    The following are the requisites to obtain an international filing date:
    • The applicant must be a national or a resident of the Philippines
    • The language of the international application must be in English or Filipino
    • The international application must contain:
      • an indication that it is intended as an international application
      • the designation of at least one Contracting State
      • the name of the applicant
      • a description of the invention
      • a claim or claims

  2. What are the contents of the international application?

    An international application shall contain:
 
  • a request (Form PCT/RO/101 in PDF Format)
  • a description
  • one or more claims,
  • one or more drawings (if any)
  • and an abstract
  1. What are the fees payable?

    The following fees are payable for an international application filed with Intellectual Property Philippines:
 
  • Transmittal Fee for the benefit of IP Philippines
  • Basic Fee for the benefit of the IB (International Bureau)
  • Designation Fee for the benefit of the IB
  • Search Fee for the benefit of the ISA (International Searching Authority)
  1. Which International Searching Authorities can be specified/chosen by the applicant to conduct the international search for international application?
 
  • Australian Patent Office
  • European Patent Office
  • Japan Patent Office
  • Korean Intellectual Patent Office
  • United States Patent and Trademark Office
  1. Aside from IP Philippines, is there any other office where a Philippine national or resident can file his international application?

    A Philippine national or resident can file his international application with the International Bureau of WIPO which acts as a receiving office for nationals and residents of all PCT Contracting States.
  1. How can I file my PCT application?

    PCT Application can be filed directly with the IP Philippines from 8:00 a.m to 12:00 a.m and 1:00 p.m to 4:30 p.m or through registered mail by the Philippine Postal Authority.
